When it is completed an email will be sent to you with a copy to the email you provide, as well as a copy to Teacup Yorkie Boutique. This will serve as a receipt for you.

Deposit

In signing this document you consent to a non-refundable deposit of $500. Puppies will only be held when a deposit has been made from the buyer to Teacup Yorkie Boutique.

Section 1 - Health Record

Breeder guarantees that at the time of delivery, the puppy is in good health. All puppies have been vaccinated, dewormed and have received age appropriate vaccinations. Breeder will provide a record to the buyer of all vaccinations and deworming. Upon arriving, should the puppy be found to have poor health of a serious nature, the breeder will provide the buyer with a replacement puppy from another litter of equal value or equal amount paid for the puppy towards purchase of another puppy with the return of the original puppy to the breeder.

Section 2 - Vet Checkup

Buyer is to arrange a check up by a qualified veterinarian within 2 business days of receiving the puppy. During this initial exam should a veterinarian detect a Genetic defect threatening the life of the dog, you must contact the seller immediately. We do this with only a two business day time frame to have a point of reference as to the health of the dog. Unfortunately we cannot control how the dog is handled after it leaves our care. In the event your vet diagnoses a life threatening genetic defect at this initial exam, you must return the puppy within two days of the exam with the veterinary report of the diagnosis. The buyer is responsible for returning the puppy and all papers (registration, Shot record) to the seller. In case of death of the puppy before the initial exam, the buyer must submit a veterinarian’s necropsy report as to the cause of the death and death must be entirely due to a congenital defect. Necropsies are generally performed at your county agricultural center for a very small of around $100. Buyer shall notify breeder immediately in the event that the puppy has an illness, or does not eat well before the initial vet exam. Failure to have the initial vet check done within two days or to notify the breeder of illness or poor eating before the initial exam will VOID this warranty. Breeder shall NOT reimburse any veterinary expenses or other expenses incurred by the buyer at any time. Breeders warranty is limited to a replacement puppy, upon the immediate return (within 2 days of vet exam) of the puppy (uninjured and unharmed), its registration papers, and a written veterinarian statement that includes the complete diagnosis of the congenital life threatening defect. Not covered - internal or external parasites, hernia, undescended testicles, under or overbite, injury, allergies, heat exhaustion, or hypoglycemia.

SECTION 3 - HEALTH GUARANTEE ON HEREDITARY DEFECTS

If your puppy is diagnosed with a life threatening hereditary defect, it will be replaced with one of equal value as soon as available if the puppy dies within the first year of the puppy’s life starting at birth, after the puppy and all papers have been returned to the breeder and all conditions of this contract have been met. Buyer is responsible for all transportation of puppies.The puppy must not be euthanized without prior written approval from the breeder or this guarantee is void. Text or email being considered acceptable written approval. Buyer understands that the following slight defects are not considered life threatening hereditary defects and therefore are not covered, included but not limited to, - hernia, parasites, undescended testicle, and under/over bites. Buyer understands that the replacement option is only valid when health problems are attributed solely to a hereditary problem and are not due to including but not limited to accident, injury, communicable diseases and hypoglycemia. In case of death, a necropsy will be required to determine if death is due to a hereditary genetic problem in order to have the puppy replaced. Failure to follow the veterinarians recommended medical advice and/or treatment while the dog is in the care of the buyer will void this guarantee. In the case where the dog is diagnosed with a life threatening hereditary defect after the first year of life - the REPLACEMENT VALUE will be prorated for up to 2 years . Hereditary Deaths in year 2 will be covered at 50% of the sale price of the dog for a replacement value towards the purchase of a new puppy from Teacup Yorkie boutique to be put towards the listing price of any available puppy. An example of how it would work: If your puppy died from a hereditary defect in the second year of life, and all the other conditions for the guarantee were met (necropsy and etc) then you would receive a 50% credit,of the purchase price of the puppy listed above towards another TEACUP YORKIE BOUTIQUE puppy.

Section 4 - Luxating Patellas

Luxating patellas and collapsing trachea can be caused by injury. Collapsing trachea is NOT covered, make sure you use a harness not a collar on your yorkie, especially when using a leash. Luxating patellas are NOT covered as they can be caused by any kind of injury to the leg including a sprain or fracture in the leg. Always be careful with your yorkie when setting them down and be mindful that yorkies can injure themselves when jumping down from high areas such as a bed or couch.

Section 5 - Veterinary Diagnosis

Veterinarians can have different medical opinions. Because of this - Teacup Yorkie Boutique retains the right to pick a veterinarian of their choosing to examine the dog in case of any health issue arising including but not limited to the fulfillment of the health guarantee. If Teacup Yorkie Boutique requests that the dog be taken to a specific veterinarian - it will be at Teacup Yorkie Boutique’s Expense for the examination and any tests or procedures approved to be done by Teacup Yorkie Boutique.

Section 6- Shipping

If shipping has been approved by breeder, arrangements will be made between breeder and buyer. Puppy becomes the sole responsibility of the buyer once the breeder delivers the puppy to transport personnel and puppy is in their care, burden of delivery to owner is considered fulfilled.

Section 7 - FULFILLMENT OF HEALTH GUARANTEE

This health guarantee applies only to the original owner of the puppy listed below in this contract as the Buyer. The Health Guarantee is not transferable. In the event the guarantee is needed, the puppy/dog must be returned to TEACUP YORKIE BOUTIQUE with any AKC papers. A refund will not be given in any situation, only a replacement puppy as soon as one of equal value can be given or the dollar amount of purchase price towards the purchase of another available puppy. Arrangements for a puppy of greater or lesser value must be done in agreement of both the buyer and seller. Shipping arrangements for an additional puppy are at the expense of the buyer, and return of a puppy to fulfill guarantee are at the expense of the buyer. TEACUP YORKIE BOUTIQUE - may choose to refund the return shipping expense of a puppy if defect is to be found to be 100% hereditary and life threatening to the puppy, but it will be at the discretion of TEACUP YORKIE BOUTIQUE.

Section 8 - CARE OF PUPPY

Buyer agrees this puppy is not being bought for resale and shall be maintained and kept under the personal control of the buyer, this puppy shall be given adequate housing, food and vet care, and shall in no manner be mistreated, neglected, or allowed to roam freely. If circumstances become so that the buyer cannot keep this dog, buyer promises not to discard the dog at any shelter, humane society, or rescue group, and make every effort to place the dog in another suitable home. If the buyer is unable to find a suitable home for the dog. The dog shall be returned to the breeder/seller listed below in this contract.

Section 9 - Breeding Rights

I acknowledge and understand I can request AKC papers to register my dog for limited registration, not Full registration. I acknowledge any dog I purchase from Teacup Yorkie Boutique is for the purpose of having a pet only and not breeding. No Breeding rights are being sold with the purchase of this dog.

Breeding Rights will not be sold under any circumstances. Accidental or Intentional breeding of the purchased puppy will be considered a breech of contract.

I expect all buyers to be honest about their intentions in buying one of our puppies. This includes the buyer to be responsible in not letting an accidental breeding regarding the puppy in this contract to occur. A minimum fee of $2,000 or greater, depending on severity of misuse of breeding rights, must be paid to TEACUP YORKIE BOUTIQUE in the event of an accidental or purposeful breeding of the puppy aforementioned. This fee must be paid within 30 days of the day of notice from TEACUP YORKIE BOUTIQUE via text, email, or in writing. Failure to pay within the 30 days from notice - will result in legal recourse to be filed and carried out in the county where the Breeder resides. The buyer agrees to pay not only the required fee mentioned above but all fees pertinent to a lawsuit including but not limited to filing fees, serving fees, and attorney’s fees incurred when the suit is filed at the county courthouse. All wrongdoing towards Teacup Yorkie Boutique WILL be prosecuted to the full extent of the law.

Section 10 - BURDEN OF CARE

The buyer will assume any and all veterinarian cost and any other expenses that might be incurred in connection with the purchased puppy and waive any cost whatsoever against TEACUP YORKIE BOUTIQUE and its owners. Buyer also acknowledges it is their burden of care when it regards potty training, general training, and all care required to raise and take care of a dog. I understand that full price is due when the puppy is picked up or before the puppy is delivered for flight.

SECTION 11 - AGREEMENT TO TERMS

Buyer agrees by signing below, to all the terms of this agreement included in sections 1-11. Under no circumstances will payment be stopped on any check, money order, cashiers check, or paypal payments which the breeder has accepted for payment of the puppy. There will be no paypal chargebacks. This written agreement is a binding contract, and is the only expressed agreement between the buyer and the seller. I understand that I (buyer) will assume any and all veterinarian costs and any other expenses that might be incurred in connection with my puppy and waive any cost whatsoever against Teacup Yorkie Boutique and its owners. I understand that full price is due when the puppy is picked up or before the puppy is delivered for flight. I understand that no other guarantees are meant or implied and I understand this contract is legally binding.

Section 12 - Hypoglycemia Discloser

Hypoglycemia is a life-threatening condition to a dog when their blood sugar drops too low and can be caused by a lack of eating. When a puppy is taken to a new home it may become stressed and choose not to eat because of it, even when food is actively given. It is the burden of care to the new owner to be mindful of this and watch for symptoms and treat accordingly. The most common symptoms of Hypoglycemia include, lethargy, vomiting, disorientation, white gum tissue, weakness and possibly even seizures. An easy way to check for low blood sugar is to check the gum tissue of the puppy. The tissue around and above the teeth should be a healthy coral pink color. If the gum tissue is white then the puppy needs immediate intervention. If you notice any of the symptoms mentioned above you need to take immediate action. A simple way to boost the blood sugar of the puppy is to place a few drops of honey on your finger and put it on the roof of the puppies mouth, forcing it to ingest it and boost the sugar levels. You can also repeat this process with canned wet dog food such as a Royal Canin Puppy Appetite Stimulator found at pet stores. Small Yorkie puppies generally eat very little but eat frequently. Typically every 3-6 hours they will eat during waking hours. If it has been 6-8 hours, and you know that the puppy has not eaten, you need to encourage it to eat with honey, appetite stimulator, kibble, or your preferred puppy food. By signing this document you are acknowledging your awareness of hypoglycemia and that the breeder has made every effort to help prevent this life-threatening event. If any veterinarian bills are incurred due to hypoglycemia they are the responsibility of the buyer. If the puppy dies due to hypoglycemia, no refund or replacement puppy will be given.
